Amendment to Work Permit for Foreigners - August 2010

NEW AMENDMENT TO WORK PERMITS FOR FOREIGNERS -  August 2010

This has certainly been a busy time in the field of Turkish Corporate Immigration. There have been new amendment to the “Application Regulation of the Law No. 4817 Related with Work Permits for Foreigners” which is published in the Official Gazette on July 31, 2010.

The amendments specify;

-Work Permit applications may now only be filed online. The signed application form and supporting documents must be sent to the Ministry within 6 business days from the on-line application date (by mail or in person).

-Certain work permit bars to those in student status have been removed (the changes are in reference to Articles 30, 33 and 38).

-The Ministry now again requires the last year’s profit and loss statement and balance sheet approved by the certified financial advisor or Tax Office. (Note that this is an unanticipated change as this was changed in the law in Feb. 2010 and made necessary only for applications made by “foreign direct investment” companies. Now, as was prior to Feb. 2010, all work permit applications will again need to include the profit and loss statement and balance sheet.)

The most immediate change is the electronic filing of applications. As you might recall, the electronic filing mechanism was initiated by the change in the regulations in January 2010 but was not working properly. We hope the glitches in the on-line program will soon be fixed and filings will proceed smoothly.
