Important Points When Signing a Rental Contract

* The blank parts -that may be in agreements- should not be filled in with handwriting but typed. Should there be any handwritten parts (as a last resort) in an agreement, these parts should be acknowledged to have been added with the mutual agreement of the parties i.e. the initials or the full signatures of the authorized signatories of the parties must be seen next to the handwritten word.

* Each page of the contracts longer than 1 page should be stamped and signed by both parties (the lessee and the lessor).

* Any addenda of the agreements should be referred to in the text of the agreement and each page of every addendum should also be stamped and signed by the lessee and the lessor as described above.

* Timely (while the contract is still negotiable) legal advice should be sought from the Legal Dept. of your company.

* Contracts should be signed by the authorized signatories of your company.

* A letter of termination and release should be signed in relation with expired contracts to document that the parties are no longer bound with the responsibilities arising out of that contract.

* The fact that there are no encumbrances on the immovable should be checked. If such situation exists, then an exit clause which would save the rights of the lessee should be added to the contract saying: "If the immovable has an encumbrance on it, then the lessee has the right to terminate the contract, in case legal action is taken by a third party concerning the encumbrance."

* In case, if you are posted to another assignment unexpectedly you should have an exit clause with minimum 2 months notice.
